Justice Gavai Flags Risks of AI in Legal Research, Cites Fake Case Citations as a Major Concern
New Delhi, March 11, 2025: Justice B.R. Gavai of the Supreme Court of India has raised serious concerns about the over-reliance on Artificial Intelligence (AI) in legal research, warning that AI platforms like ChatGPT have been found generating fake case citations and fabricated legal facts.
While AI has proven beneficial for streamlining judicial administration, Justice Gavai emphasized the ethical and professional risks that arise when lawyers depend blindly on AI-generated legal references.
Speaking at a conference organized by the Supreme Court of Kenya, Justice Gavai acknowledged the advancements AI has brought to the judicial system, particularly in case scheduling and workload management.
Several courts worldwide have successfully implemented AI-powered case management tools, optimizing judicial resources by intelligently allocating cases to judges based on workload and specialization.
Fake Citations & Ethical Risks in Legal Research
Despite its efficiency in case management, AI-driven legal research comes with serious pitfalls. Justice Gavai highlighted instances where AI tools have misled legal professionals by generating non-existent case laws and incorrect legal precedents.
This has led to lawyers citing fictitious judgments, causing professional embarrassment and potential legal consequences.
“AI lacks human discernment and ethical reasoning. While it can process vast legal data and summarize case laws quickly, it cannot verify sources with the precision of a trained legal professional,” Justice Gavai stated.
He further pointed out that the legal profession demands a nuanced understanding of statutes, precedents, and judicial reasoning, which AI, at its current stage, is incapable of delivering. AI-generated content may appear authentic but lacks the depth of human legal expertise.
A Threat to Judicial Ethics?
Justice Gavai also raised fundamental concerns about AI’s role in predicting judicial outcomes, arguing that justice is not merely a mechanical process but involves ethical considerations, empathy, and contextual reasoning.
“Can a machine, devoid of human emotions and moral judgment, truly understand the complexities of justice?” he questioned. AI-based predictive tools, while data-driven, might undermine the core principles of judicial independence if relied upon excessively.
Legal experts worldwide have debated whether AI-powered judicial analytics could create biases, influencing judicial decisions rather than assisting the process.
Justice Gavai warned against allowing AI to shape judicial reasoning, stressing that technology must serve as a support system rather than a substitute for human judgment.

While AI is revolutionizing the legal and judicial landscape, Justice Gavai emphasized the need for caution and ethical oversight in its implementation.
